Terms of service
These terms apply when you use SayCandid (saycandid.com), run by Three Chapter Media, Lithuania. By creating an account you agree to them. Questions? Contact us.
Who can use SayCandid
SayCandid is for businesses and the people working for them. You must be at least 18, and you use it for your work, not as a private consumer. If you sign up for a business, you confirm you’re allowed to act for it.
The service and its price
SayCandid lets your business ask customers for short video reviews, review and edit them, and show them on your website. It’s currently free, with the limits shown in Settings → Usage.
We may change those limits, end the free plan or add paid plans. We’ll tell you at least 30 days before a change that takes something away from you or before anything you use starts to cost money, so you can decide what to do.
Your account
- Keep your sign-in details safe; you’re responsible for what happens in your account, including by the members you invite.
- One business per account for now. Give accurate details.
- Free accounts that nobody has used for 12 months may be deleted. We’ll email you at least 30 days before, so you can sign in to keep it or download your videos.
Videos and consent
- Customers agree, on the recording page, that your business may use their video, name, role and company on your website and in ads. That consent is given to you, and you must respect it, including if they withdraw it.
- Your videos stay yours. You give us permission to store, process (captions, summaries) and show them only to run SayCandid for you.
- Only ask for reviews from real customers, and don’t edit a video so it says something the person didn’t mean.
- AI isn’t perfect. Captions, quotes and summaries are made automatically and can contain mistakes. Check them before you publish.
Who is responsible for content
SayCandid is a tool. We don’t watch, review or approve the videos, names, ratings or anything else recorded, uploaded or shared through it. Each business decides which videos it collects, approves, edits, publishes and shares, and is fully responsible for that content and for how it’s used, including having the rights and consents it needs.
- Your links are yours to control. Anyone who has one of your recording links can record and submit a video with it, so share links only with people you choose, and close a link when you no longer need it. The same goes for the widget code you put on your website.
- Your website is yours. We aren’t responsible for the websites where businesses show their videos, or for anything else on them.
- We aren’t responsible for content created, submitted, published or shared by businesses or their customers, or for any loss caused by it.
- If someone makes a claim against us because of content you collected or published, or because you broke these terms, you’ll cover the reasonable costs of that claim.
Reporting content
Anyone can tell us about a video they think is illegal or breaks these terms. Every video in a website widget has a small flag: tap it, choose what’s wrong and add a few words. You can also write to us through our contact page, which is our point of contact for users and authorities. We communicate in English.
- A report records exactly which video it’s about, the moment in it and the page it was seen on, so we can find it.
- We look at every report and act quickly. If the video is illegal or breaks these terms, we remove it from every website. Otherwise we leave it up.
- When we remove a video, we tell the business which video and why. We also tell the person who reported it what we decided.
- If you disagree with a decision, write to us and we’ll look at it again. If we were wrong, we put things back.
- We may suspend accounts that keep posting illegal content, and we may ignore people who keep sending reports that are clearly unfounded.
How we handle your customers’ data
For the videos and details your customers send, your business decides why and how they’re used (the “controller” under the GDPR), and we process them for you (the “processor”). This section is our data processing agreement with you.
- What and why: customers’ videos, voices and faces in them, names, roles, companies, ratings and consent records, and the email addresses and names you give us to invite them, kept only to run SayCandid for you, for as long as you keep them in your account.
- Your instructions only: we use this data only to provide SayCandid as you set it up, never for our own purposes, unless the law requires it.
- Confidentiality: everyone who can access it is bound to keep it confidential.
- Security: encryption in transit and at rest, strict access controls and regular backups.
- Other providers: you allow us to use carefully chosen service providers to host and store data, make captions and summaries, send emails and keep backups, under contracts with the same protections as these terms. The list is available on request, and we’ll tell you before adding a new one so you can object.
- Outside the EU: data only leaves the EU with the safeguards the law requires, such as the EU’s standard contractual clauses.
- People’s requests: if a customer asks you to see, correct or delete their data, we help you do it.
- Breaches: if we learn of a personal data breach that affects your data, we tell you without undue delay, with what you need to meet your own duties.
- At the end: when you delete videos or your account, we delete the data (after a short time in backups). Download anything you want to keep first.
- Checks: we give you the information you need to show you’re following the GDPR, and answer reasonable questions about how we protect the data.
Emailing your customers
You can ask SayCandid to email your customers a link to record a video for you. When you do:
- Their permission is yours to have: only add people who are your customers and agreed to hear from you about a review. You confirm it every time you send, and we keep a note of who confirmed it and when. Never add bought, rented or scraped lists.
- We send it for you: the email comes from your business “via SayCandid”, replies go to your account email, and the wording is ours, so nobody can be misled about who is asking. For these emails, too, your business is the controller and we are the processor, as above.
- Every email can be stopped: each one has a one-click unsubscribe. Someone who unsubscribes gets no more emails from your business through SayCandid. An address that bounces or marks one as spam gets none from anyone.
- Limits: how many you can send depends on your plan, and we may pause sending for an account whose emails are marked as spam or don’t arrive.
Not allowed
- Fake reviews, or videos that are illegal, hateful, or break someone else’s rights.
- Spam, including emailing people who didn’t agree to hear from you, or trying to get around limits, break, overload or misuse the service.
We may remove content or suspend accounts that break these rules.
Storing your videos
We work hard to keep your videos safe, but we don’t promise to store them forever or for any set amount of time. You can download your videos at any time, and we recommend keeping your own copies of anything important to you.
Changes and ending
We’re improving SayCandid all the time and may change, limit or stop features. You can stop using it and ask us to delete your account at any time.
If we ever decide to shut SayCandid down, we’ll do our best to tell you well in advance, by email and on the site, so you have time to download your videos and take them off your website. After that, your account and videos will be deleted.
Liability
We work hard to keep SayCandid running and your videos safe, but we provide it “as is”, without guarantees that it will always be available or error-free. As far as the law allows:
- we aren’t liable for indirect losses, such as lost sales, profits, data or goodwill;
- our total liability to you is limited to what you paid us in the 12 months before the claim, or €100 if that’s more.
These limits don’t apply where the law doesn’t allow them, for example for harm caused on purpose or through gross negligence.
Things outside anyone’s control
Neither of us is responsible for delays or failures caused by events we can’t reasonably control, such as outages of the internet or of our providers, natural disasters or attacks.
Showing that you use SayCandid
We may show your business name and logo on saycandid.com, in our sales materials and in our ads, to show that you use or have used SayCandid. We may adapt how they look so they fit our design, for example their size or colour, but we won’t suggest you recommend us unless you’ve told us you do. We’ll never show your videos, your customers or their words this way without asking you first.
You keep all rights to your name and logo; you only let us use them for this, for free. Don’t want it? Tell us and we’ll take them off our website and stop using them in new materials within 30 days. Ads already running may stay until the end of their run.
Feedback
If you send us ideas or suggestions, we may use them to improve SayCandid, without owing you anything for them.
Changes to these terms
We’ll update the date above when these terms change. For changes that matter, we’ll email account holders at least 14 days before they apply. If you keep using SayCandid after that, the new terms apply.
The rest
- We may transfer SayCandid and these terms to another company, for example if the business is sold, and we’ll tell you if we do. Your rights stay the same.
- If one part of these terms can’t be enforced, the rest still applies.
- These terms are the whole agreement between us about SayCandid.
- These terms are governed by the laws of Lithuania, and the courts of Lithuania handle any disputes.
